These Terms of Service (“Terms”) apply to your use of instituteofmassageandperformance.com and the website-related services of the Institute of Massage & Performance (“IMP,” “we,” “us,” or “our”), including inquiries, applications, workshop purchases, and appointment requests.
Please read these Terms before using the website or completing a transaction. By using the website or accepting these Terms where presented, you agree to them to the extent permitted by law. If you do not agree, please discontinue use and contact IMP for assistance.
Educational programs, workshops, student clinic services, and other offerings may have separate catalogs, enrollment agreements, intake forms, consent forms, and transaction-specific policies. Those documents govern their particular subjects and take priority over these general website Terms if there is a conflict. Applicable law and rights that cannot be waived always take priority.
You must have legal capacity to enter a transaction or act through an authorized parent or guardian when required. Program admission and clinic participation are subject to their own eligibility requirements. An inquiry or application does not guarantee a place, acceptance, or access to a particular service.
You may use the website to learn about IMP, contact us, apply, register, purchase available offerings, book appointments, and access authorized resources. Provide accurate information and keep relevant contact details current.
You must not use the website unlawfully; impersonate another person; misuse someone else’s information; submit malicious code; interfere with normal operation; bypass access controls; or attempt to access accounts, records, or systems without authorization. Where you have an account, protect your login details and notify IMP of suspected unauthorized access.
We may restrict website access when reasonably necessary to address misuse, protect security, or comply with law. Website access restrictions do not automatically cancel rights under a separate enrollment or purchase agreement.
Descriptions, schedules, instructors, fees, course availability, and other website details may change. Confirm the current requirements and terms for the specific offering before enrolling or purchasing. Changes to an existing enrollment or purchase remain subject to the applicable agreement and law.
Admission, completion, examination results, professional licensure, acceptance of continuing education credits, employment, income, and health or performance outcomes are not guaranteed. Licensing authorities and professional organizations determine their own requirements. Participants should verify whether a particular course meets the requirements relevant to them.
Figures, testimonials, and examples illustrate particular experiences and do not promise that every student or participant will obtain the same result.
Review the price, selected course or date, prerequisites, included materials, and payment terms before submitting an order. You authorize the payment method you provide for the amount disclosed at checkout. Payment processing may be handled by an external provider under its applicable terms.
Application fees, registration fees, tuition, workshop fees, and clinic charges may have different payment and refund conditions. The applicable catalog, enrollment agreement, course listing, booking terms, or other policy disclosed for the transaction governs cancellations, rescheduling, withdrawals, and refunds, subject to law. A fee described as nonrefundable remains subject to any refund rights required by law.
If a cancellation or refund policy is unclear, contact IMP before paying. These Terms do not create a blanket no-refund policy. If IMP cancels or cannot deliver a paid offering, we will communicate the available resolution and honor the applicable agreement and legal obligations.
An automatic payment receipt confirms that a transaction was received; it does not by itself guarantee admission to the school, fulfillment of prerequisites, or an appointment until confirmed through the applicable process.
Student clinic massage is provided by students in training with supervision. It is an educational setting. Appointment times, fees, session lengths, intake requirements, and any disclosed cancellation or late-arrival policies apply to the booking you make.
Provide relevant health and safety information through the designated intake process and tell the clinician or supervising instructor about concerns, discomfort, pressure preferences, and areas you do not want treated. You may ask questions or request that a session stop. Services may need to be adapted, postponed, or declined when appropriate for safety.
Website content and student clinic services are not a substitute for medical diagnosis or treatment by a qualified healthcare professional. These Terms do not replace a clinic consent form or waive rights relating to professional care.
We may contact you about your inquiries, applications, enrollments, orders, or appointments using the details you provide. Promotional communications are subject to your preferences and any consent required by law. You may unsubscribe from promotional emails using the message’s unsubscribe link or contact us to request that promotional calls stop. Necessary administrative or transaction messages may still be sent.
Acceptance of these Terms does not itself authorize marketing text messages or calls using an artificial, prerecorded, or AI-generated voice. Any legally required consent must be obtained through the applicable opt-in process.
The Institute of Massage & Performance SMS program is available to people who are at least 18 years old and choose to receive texts from IMP. By opting in, you confirm that you are the subscriber or authorized user of the number provided.
Mobile information and SMS opt-in or consent records are not shared with third parties or affiliates for their own marketing or promotional purposes. Providers supporting delivery may process them to perform services for IMP, as explained in our Privacy Policy.
Our Privacy Policy explains our handling of personal information and your available choices. It is a notice about data practices; accepting these Terms does not replace any separate privacy or marketing consent required by law.
The website may link to or use outside payment, booking, learning, social-media, and other services. Their terms may apply to your direct use of those services. We do not control their independent content or operations. This does not eliminate any responsibility IMP has under applicable law for its own services or handling of information.
IMP and its licensors retain rights in website text, branding, images, videos, and educational materials. You may view content for lawful personal use and use materials within any permission accompanying them. Do not reproduce, sell, distribute, or commercially exploit protected content without permission, except where the law allows. Purchasing a course does not transfer ownership of the materials.
We aim to maintain useful, accurate information, but the website may contain errors or be unavailable. To the extent permitted by law, the website and general informational content are provided “as is” and “as available,” without a promise of uninterrupted or error-free operation. This does not override express commitments made in a separate agreement.
To the extent permitted by applicable law, IMP is not responsible for indirect or consequential losses arising solely from use of, or inability to use, this website. Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, personal injury where liability cannot legally be limited, or any consumer right or remedy that cannot be waived. These website Terms are not a release of liability for educational or clinic services.
New Jersey law governs these Terms, subject to any mandatory protections that apply to you. Contact IMP first if you have a concern so we can try to resolve it. These Terms do not require arbitration or waive your right to bring an eligible claim in court.
We may update these Terms by posting a revised version and changing the date above. Material changes will receive any additional notice or agreement required by law. Changes apply prospectively and do not retroactively remove rights arising from an earlier transaction. If a provision cannot be enforced, the remaining provisions continue to apply to the extent permitted by law.
